Residents Should Have Notarized.

A power of attorney authorizes someone to act on your behalf — for financial decisions, healthcare decisions or specific transactions. Massachusetts does not always legally require notarization for a POA to be valid, but every bank, hospital and government agency that receives one will require it. An unnotarized POA is useless in practice.

Four types come through our Tewksbury office most often:

• Healthcare Proxy / Medical POA — designates a healthcare agent under M.G.L. c. 201D. Required by hospitals for medical decisions when you cannot communicate.

• Military and travel POA — used when one spouse deploys or travels, authorizing the other to manage specific affairs.

An affidavit is a written statement of fact sworn to be true under oath before a notary. The notary administers a verbal oath, you swear the contents are true, then sign. Courts, government agencies, insurance companies and immigration authorities all require properly executed affidavits. A statement not taken under oath carries far less legal weight.

• RMV Affidavit of Correction (Form 20733) — fixes errors on Massachusetts vehicle titles. One of the most common single-document notarizations we handle for Tewksbury residents.

When a minor child travels internationally without one or both parents, most countries and airlines require a notarized parental consent letter. Bring valid photo ID, the child’s birth certificate and any specific instructions from the destination country’s consulate. For DS-3053, only the absent parent’s signature needs notarization — the present parent signs at the passport office.

A Massachusetts will is legally valid without notarization — it requires two qualifying adult witnesses under M.G.L. c. 190B Art. II §2-502. But adding a self-proving affidavit under M.G.L. c. 190B §2-504 changes probate significantly. A self-proving will lets the court admit it to probate without requiring witnesses to testify. For Tewksbury families, this is the difference between a routine probate and a contested one.
