What a Massachusetts Notary Public Is — and What They Are Not

Under M.G.L. c. 222 — the Massachusetts Notary Public Act — a notary public is a state-commissioned officer with specific, limited authority. Massachusetts updated and strengthened this act in 2017. Understanding what that authority includes and where it ends prevents the most common notarization errors.

Understanding Massachusetts Notary Laws: What Residents of Dracut Should Know

A Massachusetts notary public is authorized to:

  • Take acknowledgments of deeds and other instruments
  • Administer oaths and affirmations
  • Take verifications upon oath or affirmation (jurats)

  • Certify or attest copies of documents

A Massachusetts notary public is not authorized to:

Eight Massachusetts Notary Laws Dracut Residents Encounter

Oath Administration

Notaries have authority to administer oaths and affirmations throughout Massachusetts. Jurats — affidavits signed under oath — require the notary to verbally administer an oath before the signature. Simply presenting a document and applying a seal without an oath is not a valid jurat.

Notary Journal Requirement

Since 2017, Massachusetts notaries must keep a permanent journal of every notarial act. Required fields include date, document type, signer identity verification method and the fee charged. This journal is a legal record and protects both the notary and the signer if a document is ever challenged.

Massachusetts Healthcare Proxies require two adult witnesses with no estate interest — notary signature is optional under this statute but is frequently required by hospitals, attorneys and care facilities. We provide both the notarization and the two witnesses at every visit.

Long-Term Lease Recording

Four Requirements Every Signer Must Meet

The notary verifies identity and witnesses the signature — they do not confirm you understand the document’s legal effect. That is your responsibility, typically supported by your attorney. Do not sign documents you have not read.

Every field on the document must be filled in before you appear before the notary. Blanks left in a document after notarization can invalidate the notarization or be challenged later. No blanks — complete the document before the appointment.

Five Mistakes Dracut Residents Make at Notary Appointments

Signing the document at home before the appointment

The single most common error. Massachusetts notary law requires the signature to occur in the notary’s presence. If you have already signed, the document must be reprinted and signed again before us. For multi-page loan packages, this can delay funding significantly. Always arrive with every signature line blank.

Bringing an expired ID or the wrong ID

An expired ID — even expired last week — is not acceptable for Massachusetts notarization under M.G.L. c. 222 §16. If your only ID is expired, call us before the appointment. A credible witness with valid ID who personally knows you can substitute, but this must be arranged before you arrive, not after the expired ID is discovered.

Leaving blank spaces on the document

Blank fields on a notarized document are a legal risk — blanks can be filled in after notarization, which can invalidate the entire document or expose you to fraud. All fields must be completed before signing. If a field does not apply to you, it should be filled with “N/A” or crossed out — never left blank.

Name on ID does not match name on the document

The name as it appears on your government-issued ID must match the name on the document being notarized. A middle name present on the document but absent from your license, or a maiden name versus married name discrepancy, will stop the appointment. Bring marriage certificates or name-change documentation if your name does not match.

Using an online notary service when the document requires in-person signing

Massachusetts permanently authorized Remote Online Notarization (RON) in 2023 — but not all documents qualify, not all receiving institutions accept RON and not all online notary services are correctly licensed in Massachusetts.
